1. General
The “C.A.R.E. Fair” competition is a limited-time promotion run by BMW AG, Stuttgart branch, Pascalstraße 1, 70569 Stuttgart (hereinafter referred to as “BMW Stuttgart”). Participation in this competition is subject to these terms and conditions and does not require the purchase of any goods or services.
This prize draw is not affiliated with Facebook/Instagram and is not sponsored, supported, or organized by Facebook/Instagram. The recipient of the information provided by the user is not Facebook/Instagram, but BMW Stuttgart. BMW Stuttgart indemnifies Facebook/Instagram from any liability. All questions, comments, or complaints regarding the competition should be directed to BMW Stuttgart and not to Facebook/Instagram.
2. Promotion period
The competition begins on August 16, 2025, at 7:00 a.m. and ends on August 16, 2025, at 11:59 p.m. Participation in the competition after August 16, 2025, at 11:59 p.m. is no longer possible and will not be considered for the prize draw. The winner will be contacted by BMW Stuttgart via direct message on Facebook/Instagram after the draw and can redeem the prize at Hauptstraße 189A, 70563 by September 14, 2025.
BMW Stuttgart reserves the right to terminate the competition prematurely (e.g. in the event of technical malfunctions or for legal reasons). Personal data will be collected for the purpose of conducting the competition, namely the first and last name, street, house number, postcode and city, date of birth and email address or telephone number of the winner. The data will be used exclusively for the purpose of conducting the competition and will be deleted after the competition has ended. The conditions of participation are subject to the laws of the Federal Republic of Germany. Legal recourse is excluded.
3. Eligibility
Participation is free of charge, except for any internet connection costs, and is independent of the purchase of goods or the use of a service. Eligible participants are persons (m/f/x) who are at least 21 years of age, have a valid driver's license, are stationed in Stuttgart (PCS), and have their own Facebook/Instagram profile. Each participant may only enter the competition once. Employees and relatives of BMW Stuttgart are not eligible to participate in the competition and will be excluded from participation. Participation by competition agencies and other automatically generated mass entries and submissions is expressly excluded and will not be considered when determining the winner. User-generated content must comply with applicable law. The publication of offensive, pornographic, discriminatory, political, religious, personally offensive, or similarly inappropriate posts is not permitted, and BMW Stuttgart reserves the right to delete such posts without giving reasons. Posts submitted for participation in the competition must not contain any violations of competition, trademark, or copyright laws. If a participant violates these terms and conditions, BMW Stuttgart reserves the right to exclude that participant from the competition. Participants who use unauthorized aids or otherwise gain an advantage through manipulation will also be excluded. In such cases, BMW Stuttgart may also revoke and reclaim prizes retrospectively.
4. Terms of use
To enter the competition, participants must follow the Facebook page “Military Sales Stuttgart”, post a picture or selfie with the BMW X5M US Edition on a public profile as a post (not a story) on Facebook, tag “Military Sales Stuttgart” in the post, and like and comment on the CARE Fair post from August 15 by Military Sales Stuttgart and comments on why they would like to win a weekend test drive with a BMW X5.
Participation in the competition via Facebook/Instagram is subject to the express acceptance of these terms and conditions. By actively participating in the competition in the form of fulfilling the above conditions, the terms and conditions of participation are deemed to have been accepted.
5. Prize, notification, and prize delivery
The prize includes a free weekend test drive with a BMW X5. The prize is redeemable until September 14, 2025, at the latest.
One person will be selected at random or by manual draw from all eligible participants on August 18, 2025, at 3:00 p.m. The winner will receive more detailed information in writing via the “Direct Message” function on Facebook/Instagram. The winner must provide their full and real name (first and last name), date of birth, and address details (if postal delivery is chosen for prize delivery) as well as a contact option (email or phone number) for queries. The winner should respond within 24 hours of being notified of their win and can then redeem their prize at the address Hauptstraße 189A, 70563 by September 14, 2025. To claim the prize, the winner must have a valid driver's license. If the winner does not respond within 24 hours of being notified, a new winner will be drawn. The prize can be redeemed from August 19, 2025, and is valid until September 14, 2025. The prize cannot be paid out in cash and is non-transferable. Nor can the prize be exchanged for other services. Participation in this competition does not oblige you to make a purchase from BMW Stuttgart. Purchases made at BMW Stuttgart have no influence on the chance of winning. Legal recourse is excluded.
6. Liability
BMW Stuttgart shall only be liable for damages in cases of intent and gross negligence. This shall not apply in cases of injury to life, limb, or health. This shall also not apply to breaches of material contractual obligations. These are obligations that are essential for the implementation of the competition/prize draw, as they enable it to take place and on whose fulfillment the participants can and must rely on.
Compensation for damages resulting from the breach of essential contractual obligations is limited to foreseeable damages typical for competitions/prize draws, unless there is intent or gross negligence or liability for injury to life, limb, or health.
7. Participant's assurance
The participant assures that he/she owns all rights (in particular copyrights and personal rights) to his/her profile photo for publication on Facebook/Instagram (and thus worldwide on the Internet) and that he/she does not use anyone else's name as a Facebook/Instagram user name. He/she indemnifies BMW Stuttgart against any such claims by third parties.
8. Data protection provisions
The winner will be notified via direct message. The following data will be collected for the purpose of determining the winner: name (first and last name), date of birth, email address or telephone number, and address details (if postal delivery is selected for the prize). The winner must provide their name (first and last name), date of birth, email address or telephone number, and address details (if postal delivery is chosen for the prize) via a private message to BMW Stuttgart on the BMW Stuttgart Facebook/Instagram fan page. By participating, you consent to the processing of your personal data (Art. 6 Abs. 1 lit. a DSGVO). The data provided by the winner will only be stored by BMW Stuttgart for the duration of the competition and will only be used for the purpose of conducting the competition (Art. 6 Abs. 1 lit. b) DSGVO) and will be deleted after the competition has ended. Personal data will be deleted no later than 30 days after the end of the competition, provided that there is no legal retention period to the contrary. For the purpose of conducting the competition, the data may be passed on to an agency and/or cooperation partner commissioned to conduct the competition. The data will not be passed on to third parties not involved in the competition. By participating, the participant agrees that his/her name may be published by BMW Stuttgart in the event of a win. The participant may revoke this consent at any time via Facebook/Instagram direct message.
9. Miscellaneous
Participation in the competition is voluntary. The laws of the Federal Republic of Germany apply. Should any of these provisions be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. BMW Stuttgart reserves the right to adapt the content and information contained on this fan page, as well as these conditions of participation, to changes in the legal framework.
